By filling out a Social DNA Questionnaire (“Questionnaire”) on this Website, www.esnips.com, you agree to these terms, as well as eSnips’ Terms of Use and Privacy Policy. If you do not agree to these terms, the Terms of Use or Privacy Policy, then please do not complete the Questionnaire.

1. Completing a Questionnaire
Anyone may complete a Questionnaire without opening an account or providing an email address or other personal information. In addition, you will be able to see those individuals who completed the same Questionnaire whose answers most closely matched your answers.

2. Creating an Account.
In order to save a Questionnaire, you will need to open an account, and provide us with your email address and password that you will use for your account. You must provide accurate and complete information when creating the account. We may request additional personal information in the future.

You may, if you wish, add more information to your account about yourself, such as pictures, videos, your age, time zone, country and occupation (“Your Profile”).
We may transfer that personal information within eSnips or to eSnips' third-party service providers who may perform services on the website or to you, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.

3. Social DNA Questionnaire.
If you choose to share Your Profile with other users of the website that have participated in the same Questionnaire, we shall display the following details, but only to users who have participated in the Questionnaire and whose answers most closely matched your answers: (i) Your Profile; (ii) your screen name; and (iii) the e-mail address that you provided on sign-up, provided that you agreed to make it public. For avoidance of doubt, you will be able to choose which details from Your Profile will be visible to these users. In addition, users that have participated in the Questionnaire and who had the nearest answers to your answers will not be exposed to your detailed answers.

eSnips will not show third parties your answers to any specific questions in the Questionnaire. We may share aggregate responses to the Questionnaires or demographic data and related usage information with third parties, but this will not contain any personal information that can identify an individual user.

4. Disclosure in Certain Circumstances; Governing Law and Jurisdiction.
As with other personally identifiable information, there are certain circumstances, such as the Merger, Sale or Bankruptcy of eSnips, or as necessary to comply with laws, in which eSnips may provide your answers to a Questionnaire to third parties. This Agreement is governed by the law of the State of New York, excluding its conflicts of laws provisions. Any claim or dispute under this Agreement will be decided exclusively by federal or state courts located in New York, New York. Each party agrees to the personal jurisdiction and forum convenience of such courts. This Agreement may only be amended by a written agreement signed by both parties.
