About me

I'm 5'-7", 120 lbs., brown hair, brown eyes, my ears are pierced, and I have an inny.  I've attended all Roman Catholic schools since 1st grade; but, don't let that fool you - except for the educated part. I'm attending an all girls college as a freshman and majoring in French Literature/Studies.  I love to dance, have fun, and make people laugh; but, I can be a good listener too.  I like to stay busy, learn new things, and I'll try almost anything once. I have a good work ethic and not much imagination, so I guess that makes me an adult already; although, I'll probably never really grow up.  :)

To the best of my knowledge, it is not illegal to upload copyrighted music files to stream for your own personal enjoyment nor even to allow others to share in that enjoyment; as long as you have paid for that right by actually having bought that artist's work product, due credit is given to that artist, and you take reasonable steps to protect that artist's work product from theft.  At this very second I can put my hand on three of Alizée's albums and Holly Stell's very first album.  I understand that people can and do use software to rip music streams.  It is also my understanding that that activity is the activity that is not legal.  I think that common sense will tell you that if sharing music in that way was illegal, I might conceivably be required to charge everyone who visits my home, while my music collection is playing, a fair sum and then make an accounting to several artists (or something similar), but this is not the case at all.

Locks, no matter how frail or how formidable, will continue to enjoy the tradition of only keeping honest people honest.  I think that being able to restrict music files from download is as strong and as reasonable a lock or preventative measure as should be required by any artist or court of law.  I think that streaming hosts reacting to threats of lawsuits from artists or labels by deleting songs that are reasonably protected from theft in this way infringes upon my listening rights, rights I have bought and paid for.  I think that streaming hosts deleting songs in an apparently whimsical, nonsensical, inconsistant and/or random fashion is not congruant with the concept of laws or policies being applied equally to everyone. 
 
In other words, if this hosting site believes that it is necessary to delete my copy of Alizée's "toc du mac" to stay within the letter and spirit of the law, they should not only delete my copy of that song, but also every other Esnips' client's copy of that particular song, and then every single song by Alizée on this site.  Fair is fair.
 
I think that perhaps it is time for Esnips to rather well consider what their reaction will or should be when their clients file a class action suit against them for infringing upon their own rights and/or when they lose the majority of them through attrition.  Yes, artists and music label companies are rich, influential and powerful.  But, neither you (Esnips or other clients) nor they should forget just exactly who's money made them that way.
